Dispute Resolution

DISPUTE RESOLUTION

Dispute Resolution or Alternate Dispute Resolution (ADR) generally refers to resolve a conflict, dispute, or claim without taking the matter into the Court of Law having jurisdiction. Alternative Dispute Resolution includes a collection of processes used for resolving grievances, complaints, conflicts, or disputes informally and confidentially. ADR provides alternate means to resolve disputes as compared to traditional and formal means, but it does not replace those traditional and formal means of dispute resolution.

Alternate Dispute Resolution facilitates the participating parties to reach a mutually acceptable settlement swiftly without meeting many formalities. Participating parties can choose a neutral third party with mutual agreement and that third party will communicate, develop ideas and resolve the conflict or dispute between the parties. In ADR parties have many choices to meet their needs.

Alternate Dispute Resolution also helps to develop the confidence of local and foreign investors and businessmen by facilitating prompt settlement of corporate disputes and promoting a business-friendly environment in the country.

Incorporate culture, there are a number of processes that can be used to resolve such disputes, conflicts, or claims including, mediation, arbitration, conciliation, settlement conferences, neutral fact-finding, neutral evaluation, statutory discharge hearings, grievance-based hearings, mini-trials, class action administration, dispute resolution system design, negotiation, conflict management, mediation training, and discovery management.
